5 USC 6103, SENDING AN INNOCENT” MAN TO PRISON FOR 135 YEARS... WHAT???

THE MALACHI K. YORK CASE:

In the beginning, MALACHI K. YORK, who simply wrote books, taught courses and seminars to students from all over the West Indies, US, and worldwide, who ran a 100% LEGAL Nuwaubian tribe of Moors, making major headway as an independent community, was suddenly ACCUSED of Racketeering practices; such as the illegal transporting of minors for sexual acts. An ACCUSATION whereby, the courts, the prosecution, not even the prosecution's witnesses, could produce any real proof of. In America, that kind of failure to establish basic facts, and timelines, would mean, that the case is “non-existent” and that the accused is innocent. CLEARLY NOT HERE: Not only did Judge ASHLEY ROYAL Gag... yes, 'gag' a key witness, who admitted they were pressured to lie, about the accused, and SAY that he did things that HE DID NOT, the judge conveniently decided to NOT let that key- testimony, be heard by the jury. WHY?

ACTUAL CASE DETAILS: READ CAREFULLY!!!!!

In his first hearing, after his arrest, Dr York was robbed of his presumption of innocence when presiding Judge Claude Hicks compared him to the James Warren Jones...(May 13, 1931-November 18, 1978) The individual was the leader of 'The Peoples Temple” which is known for the death of nine-hundred temple members in Jonestown Guyana, nine more in Georgetown. This was a blatant CHARACTER ASSISINATION. One of the oldest, set-ups in the book, before a major pending trial.

Now GUESS WHAT. This comparative comment, caused defendant Dr York. to be denied bail. The judicial Misconduct [went] into over-drive when when judge Ashley C. Royal was appointed to preside over the YORK case. WHY JUDGE ROYAL? Back In 1998, Ashely C. royal was simply a defense ATTORNEY, for “Oconee Regional Hospital in a , Lawsuit file by the family of DR ROOSEVELT RICHARDSON, the Supreme Grand Master of the Nuwaubian Nation of Moors [UNNM], an Organization founded by york, (Yes...York, the present defendant). Richardson was also Dr York's father in Law. Dr. Richardson fell victim to medical malpractice after a sponge (yes, a entire sponge) was left in his body, during a procedure, resulting in his death. Judge royal was very familiar with Dr York and the Nuwaubians from this case. This is called a major CONFLICT OF INTEREST. As a matter of fact Jude Royal became a judge, in December 2001 and did not withdraw from the Richardson case until May of 2002. Despite that, Ashley royal continued to serve other cases, involving Nuwaubians before, during, and after Dr. Yorks case. (?) Under USC 455, Judge Royal was REQUIRED TO disqualify himself as from that case due to the conflict of interest, because of his prior knowledge, of Dr. York. That failure to withdraw, allowed a PERSONAL BIAS' into the courtroom.

ROYAL's PRE -TRIAL INJUSTICES

During the pre-trial hearings, Royal refused to grant Dr York a continuance, the trial date after York fired his initial counsel, and hired a new attorney days before, the actual trial date. Because the continuance was refused, Dr. York's new counsel was left with a meager 5 days to prepare for trial. In addition, Judge Royal appointed > Manny Aurora, who was [already] fired by Dr. York, despite the fact that Aurora never submitted an “Entry of Appearance” which is a requirement for any attorney to serve as counsel. As a result of these two violations, Dr York's 5TH AMENDMENT Constitutional Rights [if there is such a thing anymore] to DUE PROCESS under the law, and the right to effective assistance of counsel, were denied. Royal was demanded to recuse him self several times, due to his personal bias and involvement with Dr. York which he excplicitley refused. A complaint pursuant to 28 USC 351 has been filed, on record, against Royal by 200 members of the Holy Tabernacle Ministries and of the public, who also attest to Royal's bias in the Malachi York case and several other cases.

KEY WITNESS DENIED TIME TO TESTIFY!!!!!!!!

Throughout York's case Royal turned a blind -eye to the prosecutions misconduct and facilitated this by even coaching the prosecution. 1. He rushed the defenses cases. 2. He gagged key witnesses, who were going to testify to the conspiracy against DR YORK. 3. Judge Royal, to add INSULT to injury, held court on the FEDERAL HOLIDAY, Dr. Martin Luther King Day! Another blatant violation of Federal Rules of Criminal Procedure 56(c) also defined in 5 USC 6103. But don't take our word for it. Check it out! 4) The actual case against Dr York, ended in a hung Jury, but Royal forced a guilty verdict by re-charging the jury. Dr York was actually sentenced to 135 years- that's ONE HUNDRED THIRTY FIVE YEARS, in prison. Now that is defined as CRUEL AND UNUSUAL PUNISHMENT, far off-base according to accusations against York. Royal used incorrect sentencing guidelines instead of the 1993 sentencing guidelines, which were the guidelines in place at the time of the false allegations.

JUDGE AND PROSECUTION IN “OBVIOUS CAHOOTS”

The collusion between Royal and the prosecution through MK's case was overwhelming. It is also an intrigue to notice that Judge Royal and Maxwell Wood , the head Prosecutor in Malachi's York's, case were BOTH appointed to their post, by the BUSH ADMINISTRATION in 2001. Royal responded to York's Motion to Vacate and Set Aside' or Correct Sentencing” on July 30, 2009ans US attorney Wood resigned on July 31, 2009. The continuous prosecutorial misconduct during trial, was permitted by Royal who clearly aided the prosecution in their foul tactics. Judge C Ashley erred in his decision to deny York's 2255 motion, as well as denied him of the opportunity for an EVIDENTARY HEARING due to NEW EVIDENCE. Those witnesses now confess, that YORK DID NOT COMMITT .Yet Issuance of a Certificate of Appealability to the higher courts, was likewise still denied...
